Terms of Service.

These Terms govern your use of Pitvolt. Please read them. They cover who we are, what we do, what we don't do, and what happens when a charge doesn't work.

1What Pitvolt is

1.1Pitvolt operates a marketplace and charge point management platform connecting owners of EV charging equipment ("Hosts") with people charging electric vehicles ("Drivers"). This includes the Pitvolt driver app, the host console, and the OCPP network infrastructure between them.

1.2Pitvolt does not own, install, or maintain charging hardware. Chargers on the network belong to Hosts. We provide the software, connectivity, metering, payment facilitation, and settlement layer on top.

1.3Pitvolt is not an electricity supplier or a licensed public utility. Electricity at a charge point is supplied by the Host from the Host's own metered connection. In relation to each session Pitvolt acts as a technology platform and, for payment, as a collection agent for the Host.

1.4Where these Terms describe us "charging" a Driver or "paying" a Host, we mean facilitating collection of payment on the Host's behalf and accounting for their share less our fee. The supply contract for each session is between the Driver and the Host. Payments are processed by our payment provider, which is licensed by the Bank of Ghana. We are not a payment service provider and we do not hold your funds as a deposit or e-money balance.

1.5Parts of the platform are in pilot. We may add, change, or withdraw features, sites, or payment methods, and will give reasonable notice of material changes where we can.

2Agreement and eligibility

2.1By using the platform - including starting a session, with or without an account - you agree to these Terms. If you don't agree, don't use the platform.

2.2You must be at least 18. If you use the platform for a business, you confirm you're authorised to bind it, and it's bound too.

3Accounts

3.1Drivers can charge without an account using a bay code and a one-off payment. An account is needed to save receipts, store payment methods, and see history. Hosts must hold an account.

3.2Keep your details accurate and your credentials secure. You're responsible for activity under your account. Tell us immediately at customer.service@pitvolt.com if you suspect unauthorised use.

3.3We may refuse, suspend, or close an account where we reasonably believe there's fraud, abuse, non-payment, a breach of these Terms, a safety risk, or a legal requirement to do so.

4Acceptable use

4.1You must not: tamper with or interfere with a charger or the platform; reverse-engineer it; charge a vehicle that isn't roadworthy or isn't designed for the connector used; scrape or resell platform data without written consent; obtain energy without paying; misrepresent a fault to get a refund; or use the platform unlawfully.

4.2Fraudulent refund claims will close your account and may be reported to the authorities.

5Availability

5.1We aim for high availability but we don't guarantee the platform, any charger, or any site will be available or working at any given time. Grid interruptions and load shedding, telecoms outages, host action, hardware failure, and maintenance all take chargers offline.

5.2Status, connector type, and tariff in the app are best-efforts, based on the most recent data from the charger. Status can change between you checking and you arriving.

5.3This is exactly why the Refund Policy exists. We don't promise you'll always get a charge. We promise that if you pay for one and don't get it, you get your money back.

6Liability

6.1Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything that can't lawfully be limited.

6.2Subject to 6.1, and so far as the law allows:

  • (a) We're not liable for indirect or consequential loss, or loss of profit, revenue, business, contracts, anticipated savings, goodwill, or data.
  • (b) We're not liable for loss from a charger being unavailable, offline, slower than expected, or delivering less than expected - beyond refunding what you paid under the Refund Policy.
  • (c) We're not liable for damage to your vehicle, battery, or on-board charging equipment, except where directly caused by our negligence. The hardware belongs to the Host; hardware-defect claims lie against the Host and the manufacturer.
  • (d) We're not liable for loss, theft, or damage to vehicles or property at a Host's site, or for the condition, security, access, or lawfulness of any site.
  • (e) We're not liable for the acts of Hosts, Drivers, utilities, payment providers, mobile networks, or other third parties.

6.3Cap. Subject to 6.1, our total liability in any 12-month period is limited to:

  • Drivers: the greater of GHS 2,500 or what you paid through the platform in the prior 12 months.
  • Hosts: the platform fees we retained from your sessions in the prior 12 months.

6.4Liability is reduced to the extent the other party caused or contributed to the loss.

7Indemnity

Hosts and business Drivers indemnify us against claims, losses, and reasonable costs arising from their breach of these Terms, their negligence, the condition or legality of their site or charger, and third-party claims relating to their site.

8Force majeure

Neither party is liable for failure caused by events beyond reasonable control - grid failure or load shedding, telecoms failure, Mobile Money or banking outage, fire, flood, epidemic, civil unrest, industrial action, or acts of government.

This does not remove a Driver's right to a refund for a session that didn't deliver energy. See the Refund Policy.

9Changes

9.1We may amend these Terms. The current version is always at pitvolt.com/terms with its effective date.

9.2For material changes - the platform fee, settlement timing, or the refund promise - we give Hosts at least 30 days' notice by email. A Host who doesn't accept may terminate under section 22 without penalty before it takes effect.

9.3For Drivers, the Terms in force when a session starts govern that session.

10Law and disputes

10.1These Terms are governed by the laws of the Republic of Ghana.

10.2Before formal proceedings, raise it with us at customer.service@pitvolt.com and give us 30 days. Most things resolve through the process in section 17.

10.3Otherwise the courts of Ghana have exclusive jurisdiction, save that either party may seek injunctive relief anywhere competent.

11General

11.1No partnership, employment, or joint venture is created, other than the limited payment agency in 1.4.

11.2We may assign to a group company or on a sale of the business. You may not assign without our consent.

11.3If a clause is unenforceable, the rest survives.

11.4These Terms plus the Refund Policy, Privacy Policy, and any signed Host Agreement are the entire agreement. A signed Host Agreement prevails over any conflict.

For drivers

Sections 12–17

12Starting a session

12.1Start from the driver app, or by entering the bay code at the charge point. No account required.

12.2Before you start, the app shows the tariff per kWh, the connector type, and the charger's last reported status. The tariff is set by the Host, not by Pitvolt. It varies by site and can change.

12.3Starting a session forms a contract for electricity with the Host, at the tariff displayed at start, with us facilitating payment on their behalf.

12.4Check the connector fits your vehicle and your vehicle is fit to charge. That's on you.

13What you pay

13.1You pay for energy actually delivered, metered in kWh, at the Host's tariff. Nothing else - no session fee, no connection fee, no subscription.

13.2The platform fee comes out of the Host's share. It is not added to your price.

13.3Any idle, overstay, or parking charge is between you and the Host or site operator, and will be shown before you start if it applies.

13.4VAT. Prices are in Ghana Cedis (GHS). Where the Host is registered for VAT, the price shown includes VAT and the NHIL and GETFund levies at the applicable rate. Where the Host is not VAT-registered, no VAT is charged on the session. The price you see before you start is the price you pay per kWh, either way.

14How you pay

14.1Payments are processed by our payment provider, which is licensed by the Bank of Ghana and certified to PCI-DSS Level 1 - the highest certification in the payments industry. You can pay by:

  • Mobile Money - MTN MoMo, Telecel Cash, AirtelTigo Money
  • Card - Visa, Mastercard, and any other scheme our payment provider supports
  • any other method shown in the app

14.2Pre-payment, and why. Because a charging session's final cost isn't known until it finishes, sessions begin with a pre-payment. You choose the amount - for example GHS 50, or the default shown - and the price per kWh is locked at the moment you start.

This is a real payment, not a hold. The money leaves your wallet or account when you start.

When the session finishes, we settle the exact cost of the energy delivered - always rounded down in your favour - and automatically refund the difference to the same wallet or card, without you asking. If you pre-paid GHS 50 and used GHS 38.50 of energy, GHS 11.50 comes back to you automatically. The full mechanics and timings are in the Refund Policy.

14.3Returning drivers with a saved card. If you've charged before and saved your card, we may instead charge you the exact amount at the end of the session, with no pre-payment. You'll see which applies before you start.

14.4Mobile Money authorisation. Mobile Money payments complete on your phone - you'll get a prompt from your network and you approve it there. If you don't approve it, the session won't start.

14.53-D Secure. Card payments may need extra verification from your bank. We're not liable if a session can't start because your issuer declines or times out.

14.6Card security. We never see or store your full card number, CVV, or PIN. Card details are captured and held by our payment provider, which is PCI-DSS Level 1 and ISO 27001 certified. We hold only a token that lets us charge a card you've chosen to save.

14.7Foreign cards and FX. Sessions are priced and charged in GHS. If your card was issued outside Ghana, your bank converts at its own rate and may add a foreign transaction fee - those are your bank's charges, not ours, and we can't refund them. If we refund, you get the GHS amount back; its value in your currency may differ from what you paid if the rate moved. We can't control or compensate for that.

14.8Failed payment. If payment fails after energy has been delivered, the amount is still due. We may retry, charge a saved method, or suspend your account until settled.

15Safety at a charge point

15.1Follow the instructions on the charger and any site rules. Do not use a charger that looks damaged, wet, burnt, or tampered with - report it in the app and walk away.

15.2Don't run a cable across a walkway, don't use an adaptor your manufacturer hasn't approved, and don't charge a vehicle you know has a battery fault.

15.3Move your vehicle promptly when charging finishes. Bays are shared.

15.4You're responsible for damage you cause to a charger or a site.

16Receipts

Your receipt shows the site, date and time, kWh delivered, tariff applied, any pre-payment and refund, and the net total in GHS - in the app, and by email if you have an account.

17Complaints

17.1Tell us. customer.service@pitvolt.com, or the in-app report button on the session. Include the session or bay code. We acknowledge within 2 business days, aim to resolve within 10.

17.2Escalate. Not satisfied? Ask for escalation to a director. Final position within a further 10 business days.

17.3External. Nothing here stops you complaining to a regulator or going to court. Because your payment is processed by our payment provider, a Bank of Ghana-licensed provider, you may also use our payment provider's complaints process and, ultimately, the Bank of Ghana.

17.4Driver-Host disputes. Site, parking, access, and conduct disputes are between you and the Host. We'll help - we hold the session data and we'll share what's relevant to both sides - but we're not the arbiter. Payment, metering, and refund disputes are ours to resolve.

For hosts

Sections 18–22

18Connecting a charger

18.1You confirm you own the charger or have the right to make it publicly available; have the right to make the parking space and electricity connection available; and hold any consents needed from your landlord, estate management, or local authority.

18.2Your charger must be installed and maintained by a competent, qualified electrician, compliant with applicable Ghanaian standards and the manufacturer's specification, with valid electrical certification. We don't inspect, certify, or take responsibility for your hardware or installation.

18.3Your charger must support OCPP 1.6-J or OCPP 2.0.1 and reach our endpoint. Site connectivity is your responsibility.

18.4Keep your auth key private. Anyone with your identity and auth key can impersonate your charger. Treat it like a password.

18.5You need a supply correctly rated for the charger load, and you pay your own electricity bill. The energy your charger delivers is energy you've paid your utility for. Set your tariff accordingly.

18.6You warrant that you hold an Energy Commission licence, or other licence, permit, or consent required to make electricity available to third parties at your site, and that you will tell us immediately if that changes.

19Tariffs, fees, and settlement

19.1You set your tariff. You set the price per kWh and can change it in the console. Changes apply to sessions started after. We don't set, control, or guarantee your tariff.

19.2Platform fee: a pre-arranged percentage of gross charging revenue per session. No subscription. No other charge. We only earn when your charger does.

19.3Founding host period. Hosts joining during the founding period pay 0% for their first 60 days, from the date your first session settles - not from signup, so a slipped install doesn't cost you. After 60 days the standard fee applies automatically. We'll remind you first.

19.4Settlement. Every session settles on real meter data from your charger:

gross (kWh × your tariff) − platform fee − any refunds attributable to your charger = your payout

19.5Payouts go to your nominated Mobile Money or bank account on a weekly basis, for all sessions settled and cleared in the period, subject to a GHS 50 minimum. Below that, it rolls forward to the next cycle.

19.6Timing depends on funds clearing. We remit once the Driver's payment has cleared and any chargeback or reversal window has passed. Card payments carry chargeback risk that persists after settlement - see section 21.

19.7Reserve. We may retain a reasonable reserve against pending refunds, chargebacks, or disputes on your sites, capped at 10% of your settlements over the preceding 90 days. We'll tell you if we hold one, and why, and release it as the risk passes.

19.8Errors. Underpay you, we fix it next payout. Overpay you - metering error, duplicate settlement, reversal - we may deduct from future payouts or invoice you, payable in 14 days.

19.9Taxes.

  • (a) You are responsible for your own tax on your earnings, including income tax and VAT registration where it applies to you.
  • (b) We do not withhold tax from your payouts. Your share of a charging session is money collected on your behalf from the Driver - it is not a payment by Pitvolt to you for a supply of goods or services, and no withholding tax obligation arises on it. If the Ghana Revenue Authority directs otherwise, or if we are appointed a withholding agent and the law requires it, we will withhold, tell you, and give you a withholding certificate.
  • (c) Our platform fee is a supply of services by us to you, and we will issue you a VAT invoice for it.

20Your obligations

20.1Keep your charger safe and working, fix hardware faults promptly, keep the bay accessible during your advertised hours, and keep the site reasonably lit, safe, and clean.

20.2Uptime and offline chargers.

  • (a) If your charger stops sending heartbeats, we hide it from the driver map after 48 hours. This protects drivers from travelling to a dead charger, and protects you from the refunds and bad reviews that follow. It reappears automatically the moment it reconnects - you don't need to do anything.
  • (b) If your charger is offline for 30 consecutive days, we may delist it from the network on 7 days' written notice. Tell us if you're waiting on a part or a repair and we'll hold off - this clause is for abandoned hardware, not for a host doing their best.

20.3Pausing. Pause the charger in the console whenever you need the space. Never pause mid-session. Give notice where a pause is planned.

20.4Faults - read this one. If you know your charger is faulty, pause it. A known-faulty charger left live on the map generates refunds, and those refunds come out of your settlement (Refund Policy, section 6). It also damages the network for every other host.

20.5You must not: manipulate meter readings; run sessions on your own charger to inflate utilisation; take payment off-platform for a session started on-platform; or discriminate between Drivers unlawfully.

21Chargebacks

21.1Where a chargeback succeeds on a session at your charger and the cause was charger-side, the amount and any scheme fee may be deducted from your settlement or recovered under 19.8. Where the cause was platform-side, we absorb it.

21.2We defend chargebacks with session evidence: meter data, timestamps, telemetry, the tariff displayed at start, and our refund records.

22Term and termination

22.1Either side may terminate on 30 days' written notice. No lock-in, no exit fee.

22.2We may suspend or delist a charger immediately for a safety risk, fraud risk, legal or regulatory issue, or serious breach.

22.3On termination:

  • (a) We settle all cleared sessions in the normal weekly cycle. We don't hold your money hostage.
  • (b) We may retain a reserve of up to 10% of your settlements over the final 90 days, held for 120 days from your last session, to cover chargebacks and refunds that arrive after you've left. Card schemes allow cardholders to dispute a transaction for up to 120 days, which is why the period is what it is. The balance - the other 90% - is paid out normally. Whatever's left of the reserve after 120 days is paid to you.
  • (c) Your charger is disconnected from the network.
  • (d) Sections 6, 7, 19.8, 21, and the Privacy Policy survive.

23Definitions

Bay code
The code at a charge point used to start a session.
Charger / charge point
EV charging equipment on the network, owned by a Host.
Driver
A person using the platform to charge a vehicle.
Host
A person or business who connects a charger to the network.
kWh
Kilowatt-hour, the unit of energy the charger's meter records.
Mobile Money
A mobile wallet payment service licensed in Ghana.
OCPP
Open Charge Point Protocol.
Payment provider
Our licensed payment service provider.
Platform
The Pitvolt driver app, host console, website, and network infrastructure.
Platform fee
The percentage of gross charging revenue we retain per session.
Pre-payment
An amount you choose and pay at the start of a session, reconciled against actual energy delivered at the end, with the balance refunded automatically.
Session
A single charging event, start to stop.
Settlement
The calculation of what's due to a Host after a session.
